End User License Agreement

This agreement

This End User License Agreement ("EULA") governs your use of any software application, mobile app or desktop application published by Luis Carranza, LLC ("we", "us"). It is an agreement between you and Luis Carranza, LLC only — not with Apple, Google or any other platform provider.

Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, for your own use, in accordance with the rules of the store you downloaded it from.

What you may not do

• Copy, modify, translate, reverse engineer or decompile the app, except where the law expressly permits it.
• Rent, lease, lend, sell, redistribute or sublicense it.
• Remove or alter any copyright, trademark or attribution notice.
• Use it to break the law, infringe anyone's rights, or distribute malware.
• Use automated means to extract data from the app or its services.

Ownership

The app, its code, design, trademarks and all related intellectual property remain the property of Luis Carranza, LLC or its licensors. You receive a licence to use it — not ownership of it.

Purchases and subscriptions

Some features may be sold through the platform store. Billing, renewals, cancellations and refunds are handled by that store under its own terms, not by us.

No warranty

The app is provided "as is". To the maximum extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted or error-free.

Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or relating to the app is limited to the amount you paid for it in the twelve months before the claim, and we are not liable for indirect or consequential losses. Nothing excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

Maintenance and support

We are responsible for providing maintenance and support for the app. The platform provider — for example Apple — has no obligation to do so.

Termination

This licence ends if you breach the EULA. On termination you must stop using the app and delete it. The sections on ownership, warranty, liability and governing law survive.

Third-party beneficiary

If you obtained the app from the Apple App Store, Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.

Governing law

This EULA is governed by the laws of the State of Delaware, United States. The courts of Delaware have exclusive jurisdiction, except where consumer law in your country of residence gives you the right to sue locally.
